These Terms of Service govern access to and use of the Death Counter service (deathcounter.kasaicore.com), including the stream overlay, death tracking, chatbot integration, and sound upload features. By accessing or using any part of this service you agree to these Terms in full. If you do not agree, you must not use the service.
The service is provided for personal, non-commercial use by Twitch streamers and their communities. You agree to use the service only for its intended purpose and in compliance with all applicable laws. You must not:
You must be at least 16 years old to use this service. If you are under 16, you may only use the service with the verifiable consent of a parent or legal guardian, as required by Art. 8 GDPR. By using the service you confirm that you meet this age requirement. The operator reserves the right to suspend accounts where this requirement is not met.
Access to the service is tied to your Twitch account via OAuth. You are responsible for maintaining the security of your Twitch credentials. The operator is not liable for any loss or damage arising from unauthorised access to your account. You may disconnect the service from your Twitch account at any time through Twitch's connected apps settings.
Users who are granted upload access may upload audio files to the service. Uploads are reviewed before becoming active. By initiating an upload, you automatically confirm that the audio does not infringe any third-party rights or contain illegal content, and that you accept full liability as set out below. No separate acknowledgement is required at the time of upload. By uploading any audio content, you represent and warrant that:
Copyright notice: There is no "15-second rule" or similar threshold under German or EU copyright law. Any reproduction or public use of copyrighted audio — regardless of length — requires the rights holder's permission or an applicable statutory exception (e.g. §§ 51, 51a UrhG). Uploading even a short clip of a copyrighted song, sound effect, or recording without a licence is a copyright infringement. This applies equally to content from streaming platforms, YouTube, games, films, and other media.
By uploading content, you agree to fully indemnify and hold harmless the operator from and against any and all claims, damages, fines, penalties, costs, and legal fees (including attorney fees) arising from or related to your uploaded content — including but not limited to copyright infringement claims, regulatory actions, and third-party lawsuits. This obligation survives deletion of the content and termination of access.
This indemnification is consistent with the liability framework under §§ 9–10 DDG (implementing the EU Digital Services Act, Regulation 2022/2065).
The operator reserves the right to remove any content — including uploaded sounds — at any time, without prior notice, if it is suspected or confirmed to violate these Terms or applicable law. The operator will act promptly upon receiving a valid takedown request.

The operator may suspend or permanently revoke access to the service — or to specific features such as sound uploads — at any time and without prior notice, in particular where a user:
No refund or compensation applies in the event of suspension or termination, as the service is free of charge.
The service is provided "as is" without warranty of any kind, express or implied. The operator does not guarantee uninterrupted availability, error-free operation, or permanent storage of any data or uploaded files.
To the fullest extent permitted by applicable law, the operator's liability for any damages arising from use of the service — including loss of data, interruption of service, or indirect damages — is excluded, except in cases of intentional misconduct or gross negligence.
The operator's collection and use of personal data is described in the Privacy Policy, which forms part of these Terms.
The operator may update these Terms at any time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the service after a change constitutes acceptance of the updated Terms.
These Terms are governed exclusively by the laws of the Federal Republic of Germany, including the EU Digital Services Act (DSA, Regulation 2022/2065) and the German Digital Services Act (DDG). The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply. Exclusive place of jurisdiction for all disputes is Germany.
This service is operated from Germany. German and EU law apply regardless of the user's country of residence. Users outside the EU access this service voluntarily and are subject to these same Terms.
